Participation Waiver and Release of Liability

Acknowledgment of Risks

I, the undersigned, voluntarily agree to participate in the Movement for Mary 5K .

I understand and acknowledge that participation in running and related activities involves inherent risks, including but not limited to:

• Slips, trips, or falls;
• Collisions with objects or other participants;
• Adverse weather conditions;
• Terrain-related hazards, such as uneven surfaces, rocks, and potholes;
• Physical injuries, including but not limited to sprains, fractures, dehydration, heat exhaustion, or cardiovascular events.

I understand that these risks could result in property damage, personal injury, or death. I voluntarily assume all risks associated with my participation in the Event.

Waiver of Liability

In consideration of being allowed to participate in the Event, I hereby waive, release, and discharge the the Movement for Mary organizing committee, their respective officers, directors, members, volunteers, sponsors, and any other affiliated individuals or entities (collectively, "the Released Parties") from any and all liability, claims, demands, or causes of action that may arise from my participation in the Event, including but not limited to claims arising from the negligence of the Released Parties.

This waiver applies to personal injury, property damage, and wrongful death, whether caused by active or passive negligence of the Released Parties or otherwise, to the fullest extent permitted by law.

Medical Fitness and Authorization

I certify that I am physically fit and have no medical condition that would prevent me from safely participating in running or related activities. I agree to stop participating if I experience discomfort, pain, or other symptoms that may indicate a health issue.

In the event of an emergency, I authorize the Released Parties or their representatives to secure medical treatment on my behalf. I agree to assume all costs associated with such treatment.

Photography and Media Release

I understand that photographs, videos, or other media may be taken during the Event. I grant the Movement for Mary organizing committee permission to use such media for promotional, educational, or informational purposes in print, digital, or social media formats without compensation or further consent.

Compliance with Rules

I agree to abide by all rules and guidelines established by the Event organizers and their representatives. I understand that failure to comply may result in my removal from the Event without refund or compensation.

Indemnification

I agree to indemnify and hold harmless the Released Parties from any and all claims, liabilities, or expenses arising out of my participation in the Event, including but not limited to claims brought by third parties alleging negligence or wrongful acts on my part.

Governing Law

This waiver and release of liability shall be governed by and construed in accordance with the laws of the State of California. Any disputes arising from this agreement shall be resolved exclusively in the courts of Santa Barbara County, California.

Severability

If any provision of this waiver is found to be unenforceable or invalid, the remaining provisions shall remain in full force and effect.

Acknowledgment and Acceptance

I have read and fully understand this waiver and release of liability. By signing below, I agree to its terms and conditions and acknowledge that I am voluntarily waiving certain legal rights.
